Abstract:
Network information law enforcement and its effectiveness are related to the legalization and standardization of network information governance. In the field of data security, network information law enforcement has shown an overall trend of continuous expansion of the field of law enforcement, increasingly clear scope of law enforcement, and gradual strengthening of law enforcement. However, in practice, there are still many difficulties in network information law enforcement at both the entitative and procedural levels. At the entity level, the risks of determining the legitimacy of electronic evidence, the risk of data leakage, the idling of the administrative law enforcement supervision system, and the operation risk of the legal review system are prominently manifested. Procedural risks are mainly reflected in the ambiguity of case jurisdiction, the poor operation of cross-departmental investigation and assistance in evidence collection, the low credibility of the non-judicial appraisal scope inspection (testing), and the unclear application of the rapid handling mechanism for admitting mistakes and accepting punishment. Network information department should follow the thinking of “system improvement, technology empowerment, and mechanism innovation”, and continue to improve the rule system, coordination mechanisms, and supporting procedures in the field of law enforcement, with the deepening of law enforcement reform and the improvement of law enforcement efficiency as the traction, so as to contribute to Chinese modernization with the high-quality development of the network information industry.
